Building Regulations Dutyholder Appointment and Competence Declaration

About this document

What it’s for

Since 1 October 2023, Part 2A of the Building Regulations 2010 (introduced under the Building Safety Act 2022) gives clients, designers and contractors legal duties to plan, manage and monitor work so that it complies with the Building Regulations, and to have the right competence. Where there is more than one contractor, the client must appoint a Building Regulations principal designer and principal contractor. This document records the appointments, competence checks and the compliance declarations.

When to use it

  • On any project needing Building Regulations compliance in England
  • When submitting a building notice or full plans application
  • At completion, to give the required declarations

What’s inside

The document is laid out in the sections below. Each one comes with a plain-English guidance note explaining what it does and what to change.

  • Part 1 – Appointments
  • Part 2 – Competence checks
  • Part 3 – Completion declarations

How to complete it

  • Record appointments in Part 1 and competence checks in Part 2
  • Keep records of how compliance was planned and monitored
  • Complete the declarations in Part 3 at completion and send them to the building control body as required

Key points to check

  • These roles may be held by the same people as the CDM roles, but they are separate legal duties
  • Higher-risk buildings (18 m+ or 7+ storeys with 2+ residential units) have a much stricter regime – take specialist advice

Our templates are professionally structured starting points for UK businesses, not legal advice. For anything complex, unusual or high-value, have your final version checked by a solicitor.
