Competition and Prize Draw Terms

About this document

What it’s for

Terms and conditions for a prize promotion run by your business – a free prize draw, a purchase-linked draw, a skill competition or a social media giveaway. They come with a summary panel, alternative entry wording for each type of promotion, a winner declaration and a pre-launch checklist.

When to use it

  • Any time you offer a prize that is won by chance or by skill
  • Social media “like, follow and comment” giveaways
  • Purchase-linked draws (“buy any product to be entered”)

What’s inside

The document is laid out in the sections below. Each one comes with a plain-English guidance note explaining what it does and what to change.

  1. The promotion and the Promoter
  2. Definitions
  3. Who can enter
  4. How to enter
  5. Free entry route
  6. Entry rules
  7. Judging (competitions only)
  8. Selecting the Winner
  9. Notifying and confirming the Winner
  10. The Prize
  11. Announcing Winners and publicity
  12. Ownership and use of entries
  13. Personal data
  14. Liability
  15. Changes, suspension and cancellation
  16. Disqualification
  17. Complaints, governing law and jurisdiction

How to complete it

  • Complete the Key Details panel first – it drives the rest of the terms
  • Choose ONE entry option in clause 4 and delete the others
  • Run through the pre-launch checklist in Appendix A
  • Publish the terms before the promotion opens and keep the winner selection record

Key points to check

  • Never charge for entry to a game of chance without a genuine free entry route, or it may be an illegal lottery
  • Northern Ireland has different gambling law – take advice or exclude NI residents
