Late Payment Interest and Compensation Letter

About this document

What it’s for

A letter to a business customer formally claiming statutory interest and fixed compensation on overdue invoices under the Late Payment of Commercial Debts (Interest) Act 1998, with a calculation table. It includes a worked example and a step-by-step guide to the calculation so you can get the figures right.

When to use it

  • When a business customer pays late (or has not yet paid) and your contract does not set its own interest rate
  • After the invoices have been paid late – you can still claim interest and compensation for the late period
  • Alongside, or after, a final demand

What’s inside

The document is laid out in the sections below. Each one comes with a plain-English guidance note explaining what it does and what to change.

  • A letter claiming statutory interest and fixed compensation from a business customer
  • How statutory interest and compensation work
  • Your entitlement under the Late Payment of Commercial Debts (Interest) Act 1998
  • A worked calculation table for each invoice

How to complete it

  • Work out the reference rate for each invoice using the guidance on this page
  • Complete the calculation table for every invoice – one row each
  • Choose the option paragraph that matches whether the original invoices are still unpaid
  • Issue a separate request or non-VAT invoice for the interest and compensation

Key points to check

  • The Act applies only where both parties are acting in the course of a business – never to consumers
  • If your contract sets its own interest rate or compensation (and it is a substantial remedy), you must use that instead
  • Fixed compensation is £40 (debts under £1,000), £70 (£1,000 to £9,999.99) or £100 (£10,000 or more) per invoice – these figures were checked on gov.uk in November 2026
  • The Commercial Payments Bill (2026) may change some of these rules – check gov.uk before relying on this letter after 2026
