Late Payment, Suspension and Adjudication Notices

About this document

What it’s for

Three ready-to-send letters for contractors and subcontractors who have not been paid under a construction contract, using the statutory rights in Part II of the Housing Grants, Construction and Regeneration Act 1996 (the “Construction Act”) and the Scheme for Construction Contracts: a late payment demand (which can also act as a default payment notice), a notice of intention to suspend work, and a notice of adjudication.

When to use it

  • When a main contractor or commercial client has not paid by the final date for payment
  • When the payer has not issued a payment notice or a valid pay less notice
  • When a payment dispute needs a fast, binding decision through adjudication

What’s inside

The document is laid out in the sections below. Each one comes with a plain-English guidance note explaining what it does and what to change.

  • Before you send anything – check the basics
  • Payment timeline
  • 1. The parties
  • 2. Nature and brief description of the dispute
  • 3. Where and when the dispute arose
  • 4. Redress sought
  • 5. Appointment of the adjudicator
  • Adjudication – next steps checklist

How to complete it

  • Check the contract’s payment terms and work out the due date and final date (see the timeline)
  • Use the letters in order unless the situation is urgent
  • Send by a method the contract allows for notices, and keep proof of sending
  • Take legal advice before starting adjudication or suspending work on a high-value contract

Key points to check

  • The Construction Act does not cover work for a homeowner on the home they live in
  • Get the dates right – a notice served too early or with the wrong content may be invalid

Our templates are professionally structured starting points for UK businesses, not legal advice. For anything complex, unusual or high-value, have your final version checked by a solicitor.
