Moral Rights Waiver and Copyright Assignment Confirmation

About this document

What it’s for

Creators of artistic, literary, musical and film works have “moral rights” that stay with them even if they assign the copyright. These include the right to be credited and the right to object to “derogatory treatment” – such as editing, cropping or combining the work in a way that harms their reputation. Moral rights cannot be assigned, but they can be waived in writing. This deed confirms the copyright assignment and records the waiver, which is essential for logos, brand assets and content you will adapt over time.

When to use it

  • When commissioning a logo, brand identity, illustration, photography, copy, music or video that you will edit or adapt
  • When the original contract did not deal with copyright or moral rights clearly
  • Before selling a business or raising investment, to tidy up ownership of key creative assets

What’s inside

The document is laid out in the sections below. Each one comes with a plain-English guidance note explaining what it does and what to change.

  1. Assignment of copyright
  2. Waiver of moral rights
  3. Creator’s confirmations
  4. Further assistance
  5. Law

Also included

  • Schedule – The works
  • Execution as a deed

How to complete it

  • List the works in the Schedule as precisely as possible
  • Choose whether the waiver is unconditional or subject to conditions (for example a credit on certain uses)
  • The creator signs as a deed in front of a witness

Key points to check

  • A waiver by one joint author does not affect the others – get a waiver from every author
  • Employees’ work created in the course of employment usually belongs to the employer already, but moral rights can still apply in some cases
