Payment Plan Agreement

About this document

What it’s for

A short, binding agreement letting a customer pay an overdue balance in instalments. It confirms the amount owed, sets out the instalment schedule, explains what happens to interest and the customer’s account during the plan, and says what happens if a payment is missed.

It is designed for straightforward, recent debts. For larger or older debts, or where you want a stronger written acknowledgement and default provisions, use the Debt Acknowledgement and Repayment Agreement in this pack.

When to use it

  • When a customer asks for time to pay and you are willing to agree
  • After a final demand, as an alternative to legal action
  • To record an arrangement agreed by phone

What’s inside

The document is laid out in the sections below. Each one comes with a plain-English guidance note explaining what it does and what to change.

  1. Definitions
  2. Acknowledgement of debt
  3. Payment by instalments
  4. Interest and charges
  5. Customer’s undertakings
  6. The Customer’s account during the plan
  7. Default

  9. Data and confidentiality
  10. General
  11. Governing law and jurisdiction

Also included

  • Schedule 1 – The Outstanding Balance
  • Schedule 2 – Instalments and payment details

How to complete it

  • Fill in the parties, the balance and the invoices it covers in Schedule 1
  • Complete the instalment schedule in Schedule 2 – check the instalments add up to the total
  • Choose the interest option in clause 4 and the account option in clause 6
  • Both parties sign; keep a signed copy on the customer file

Key points to check

  • For consumers: keep the plan free of interest and charges, and within 12 months and 12 instalments, unless you have taken advice – otherwise it may be regulated consumer credit needing FCA authorisation
  • A plan does not cancel your right to the full debt – clause 7 explains how the full balance becomes payable again on default
  • Do not agree to accept less than the full amount in this document – use a settlement agreement or deed for that
