Rent Arrears Letters

About this document

What it’s for

A staged approach to chasing unpaid rent from a residential tenant in England. Each letter is complete and ready to send, with alternative paragraphs for common situations, and each signposts free debt advice. It helps you recover arrears early, keep a clear paper trail and, if it comes to it, show a court that you acted fairly before relying on the rent arrears possession grounds.

When to use it

  • Letter 1 – a few days after a missed or short payment
  • Letter 2 – if Letter 1 is ignored or arrears keep building (usually 14 days later)
  • Letter 3 – before you serve a section 8 notice on Grounds 8, 10 and/or 11
  • The payment plan confirmation – whenever you agree to accept instalments

What’s inside

The document is laid out in the sections below. Each one comes with a plain-English guidance note explaining what it does and what to change.

  • Before you send any letter
  • The Renters’ Rights Act rent arrears grounds (England)
  • Notes on Letters 2 and 3
  • Tenant’s confirmation
  • Rent statement
  • Contact log

How to complete it

  • Update the rent statement first and enclose it with every letter
  • Choose one Option paragraph where offered and delete the others
  • Send to every named tenant (and to any guarantor, where shown)
  • Record every letter, call and message in the contact log

Key points to check

  • Ground 8 now needs at least 3 months’ (or 13 weeks’) arrears both when the notice is served and at the hearing
  • Never threaten, harass or lock out a tenant – only a court can end the tenancy
  • You may only charge late-rent interest if the tenancy allows it and within the Tenant Fees Act 2019 limit
