Rent Increase Notice Guidance and Covering Letter

About this document

What it’s for

Since 1 May 2026, the only lawful way to increase the rent on a private assured periodic tenancy in England is the section 13 process using the prescribed Form 4A. This document explains that process in plain English, helps you choose a defensible new rent, and gives you a covering letter to send with the form.

When to use it

  • When you want to increase the rent on a private residential tenancy in England
  • At least two months (plus a margin for service) before the date you want the new rent to start
  • No more than once a year, and not during the first year of the tenancy

What’s inside

The document is laid out in the sections below. Each one comes with a plain-English guidance note explaining what it does and what to change.

  • Part 1 – How the section 13 process works
  • What is the “open market rent”?
  • Part 2 – Step-by-step checklist
  • Before you prepare the notice
  • Preparing and serving the notice
  • After service
  • Part 3 – Worked example
  • Why I am proposing this increase
  • What happens next
  • Conclusion
  • Part 5 – Record of service

How to complete it

  • Read Part 1 and work through the checklist in Part 2
  • Collect market evidence in the schedule in Part 4
  • Complete the current Form 4A from gov.uk (this pack does not reproduce the form)
  • Send the covering letter with the form and complete the service record

Key points to check

  • Rent review clauses in private tenancies no longer work after 1 May 2026
  • A tenant can ask the First-tier Tribunal to set the rent – it cannot set more than you proposed
  • Do not change the wording of Form 4A
