Talent and Performer Agreement

About this document

What it’s for

When you film, photograph or record someone for a commercial project, you need their written agreement to use their performance and likeness in the way you intend. Performers have legal rights in their recorded performances, and usage terms (where and for how long the content can be used) are often the biggest cost and the biggest cause of disputes. This agreement records the booking, the fee, the buyout and the consents you need.

When to use it

  • When booking talent directly or through an agent for a shoot, advert, corporate video, podcast or event
  • When extending the usage of existing content (use the usage table in Part 2)
  • Not for crew or freelance creatives – use the Freelance Creative Terms

What’s inside

The document is laid out in the sections below. Each one comes with a plain-English guidance note explaining what it does and what to change.

  • Part 1 – Booking details
  • Part 2 – Usage (media, territory and term)
  • Part 3 – Terms: services, consents and rights, fees and cancellation, conduct and safety, confidentiality, status and tax, children, data protection

How to complete it

  • Fill in the booking details and the usage table carefully – media, territory and term
  • Agree the fee, buyout and any repeat or extension fees
  • If the performer is under 16, apply for a child performance licence from the local authority before the shoot

Key points to check

  • If an agent is involved, check their terms and who pays commission
  • Consider the performer’s employment and tax status – most are self-employed, but check
