Trustee Declaration of Eligibility

About this document

What it’s for

A signed declaration that a trustee – or a person in a senior manager position – is not disqualified from acting under the Charities Act 2011 automatic disqualification rules (widened on 1 August 2018), is willing to act and agrees to the charity’s checks. It gives the board evidence that it has done its due diligence.

When to use it

  • Before anyone is appointed or elected as a trustee
  • Before appointing a chief executive or finance lead (or equivalent)
  • Every year, to re-confirm eligibility for all trustees and senior managers

  • Criminal convictions (unspent) and status

Key points to check

  • Acting while disqualified is a criminal offence and a reportable serious incident
  • Scotland’s rules changed on 31 August 2025 – use OSCR’s guidance for Scottish charities
