Appropriate Policy Document (Special Category and Criminal Offence Data)

About this document

What it’s for

Most businesses that hold sickness records, occupational health information, diversity monitoring data, DBS results or similar must have an “appropriate policy document” (APD). It explains which Schedule 1 conditions you rely on, how you meet the data protection principles for this data, and how long you keep it. Without one, much of your processing of this data may be unlawful.

When to use it

  • If you employ staff and keep sickness, health, disability or right-to-work information
  • If you carry out DBS or other criminal records checks
  • If you collect diversity or equality monitoring data, or health data about customers or clients

What’s inside

The document is laid out in the sections below. Each one comes with a plain-English guidance note explaining what it does and what to change.

  1. About this policy
  2. Definitions

Also included

  • Part 2 – Our processing and the conditions we rely on
  • Part 3 – How we comply with the principles
  • Part 4 – Retention and erasure
  • Part 5 – Review and record of this document

How to complete it

  • Tick the processing that applies to you in Part 2 and delete the rest
  • Complete the retention column using your Data Retention Policy and Schedule
  • Keep the APD under review, record reviews in the control table and keep it for 6 months after the processing ends

Key points to check

  • You must be able to give the APD to the Information Commission if asked
  • Explicit consent does not need an APD, but most employers should not rely on consent for staff data
