Children’s Data and Age Assurance Checklist

About this document

What it’s for

Children’s data needs extra protection under UK data protection law, and online services likely to be accessed by children must follow the ICO’s Age Appropriate Design Code (the Children’s Code). This checklist helps clubs, tutors, childcare, leisure, retail and online businesses check what they collect, how they ask for consent, how they check age and how they explain things to children and parents.

When to use it

  • If you collect information about children – for bookings, classes, parties, competitions or memberships
  • If your website, app or game is likely to be used by under-18s
  • Before launching a new product, service or feature aimed at families or young people

What’s inside

The document is laid out in the sections below. Each one comes with a plain-English guidance note explaining what it does and what to change.

  • Part 1 – Scoping
  • Part 2 – Lawful basis and consent
  • Part 3 – Children’s Code standards (online services)
  • Part 4 – Age assurance
  • Part 5 – Offline activities, photos and security
  • Part 6 – Action plan

How to complete it

  • Answer Part 1 to decide which parts apply
  • Work through the checklist and note any actions
  • Carry out a DPIA where Part 1 says so and keep this checklist with it

Key points to check

  • In the UK, a child aged 13 or over can consent to an online service offered directly to them; below 13 you need parental consent where you rely on consent
  • The Online Safety Act 2023 adds separate duties for many online platforms – take advice if you host user content
