Data Protection Officer Assessment and Data Protection Lead Role Description

About this document

What it’s for

Some organisations must appoint a Data Protection Officer (DPO) under Article 37 UK GDPR. Most small businesses do not – but they still need someone responsible for data protection. This document helps you make and record the decision and gives you a role description for either a formal DPO or a data protection lead.

When to use it

  • When setting up your data protection arrangements
  • When your business grows or starts large-scale monitoring or processing of sensitive data
  • When the person responsible for data protection changes

What’s inside

The document is laid out in the sections below. Each one comes with a plain-English guidance note explaining what it does and what to change.

  • Part 1 – Do we need a DPO?
  • Part 2 – Data Protection Officer: role description
  • Part 3 – Data protection lead (where no DPO is needed)

How to complete it

  • Answer the questions in Part 1 and record the conclusion
  • Use Part 2 if you need a DPO, or Part 3 for a data protection lead
  • Publish DPO contact details and tell the Information Commission if you appoint one

Key points to check

  • A DPO must be independent, properly resourced and must not have a conflict of interest
  • If you voluntarily call someone a “DPO”, the legal requirements for DPOs apply to them
