Disciplinary Policy and Procedure

About this document

What it’s for

A complete disciplinary policy setting out how you deal with conduct problems: informal action, suspension, investigation, hearings, warnings, dismissal and appeals. It is written to meet the Acas Code of Practice on Disciplinary and Grievance Procedures, which employment tribunals must take into account.

When to use it

  • Adopt it for all employees and refer to it in your contracts or staff handbook
  • Follow it every time a conduct issue may lead to formal action
  • Use with the invitation and outcome letters in this pack

How to complete it

  • Add your organisation name and the job titles of the people who will investigate, hear and decide appeals
  • Choose your warning durations in clause 11 and check the gross misconduct list in clause 12 suits your work
  • Decide whether the policy is contractual (we recommend it is not – see clause 2)
  • Issue it to staff and keep a record that they received it

Key points to check

  • Acas consulted on a revised Code in summer 2026 – check acas.org.uk for any new version before you adopt this policy
  • From 1 January 2027 the unfair dismissal qualifying period falls from two years to six months, so a fair process matters for almost everyone
