Employee Data Privacy Notice

About this document

What it’s for

A privacy notice for your workforce that meets the transparency requirements of Articles 13 and 14 of the UK GDPR. It explains what personal data you collect about employees, workers and job applicants, your purposes and lawful bases, who you share it with, how long you keep it, the individual’s rights and how to complain – including the new complaints procedure under the Data (Use and Access) Act 2025.

When to use it

  • Give it to every new starter, with their contract
  • Give the applicant section to job applicants when you collect their data
  • Re-issue it when you change how you use staff data (for example new monitoring)

What’s inside

The document is laid out in the sections below. Each one comes with a plain-English guidance note explaining what it does and what to change.

  1. Who we are and what this notice covers
  2. The personal data we hold about you
  3. Where we get your data from
  4. Why we use your data and our lawful bases
  5. How we use special category and criminal offence data
  6. Automated decision-making
  7. Who we share your data with
  8. International transfers
  9. How long we keep your data
  10. Your rights
  11. Complaints
  12. Job applicants

How to complete it

  • Fill in your details and data protection contact
  • Check each table row against what you really do – delete or add rows
  • Set retention periods that match your retention schedule
  • Make it easy to find (for example in the handbook and on your intranet)

Key points to check

  • Do not rely on consent for most employment processing
  • An appropriate policy document is needed for most special category data
  • Pay the ICO data protection fee unless you are exempt
