Parent Contract and Terms

About this document

What it’s for

The written agreement between your setting and the parents of each child. It sets out the booked sessions, fees, how funded hours work (free at the point of use, with optional extras only), deposits, payment, absence and sickness, closures, collection, notice and complaints, with schedules for the booking, optional extras and closure dates.

When to use it

  • For every child, signed before the first session
  • When a booking changes significantly (re-issue Schedule 1)
  • When you change fees or terms (give the notice in clause 20)

  • Check clauses 6 and 7 against your local authority provider agreement for funded hours
  • Complete Schedules 1 to 3 for each family
  • Give parents time to read it and a copy to keep

Key points to check

  • Parents are consumers: terms must be fair, transparent and prominent (Consumer Rights Act 2015)
  • Funded hours must be free – no compulsory top-up, consumables or registration charges
